4. Do you propose to revise the thickness of topsoil that will be replaced? <br />5. Do you intend to revise the currently approved buffer distances (50 feet on the east, north <br />and west sides; 200 feet on the south side)? <br />6. Explain what is meant by "fines and overburden will be used to level the azea:" Do you <br />intend to backfill the pondllake with fines and overburden? <br />7. Have the water rights issues been resolved with the State Engineer's Oflice (SEO)? <br />8. Will the discharge permit transfer to the new operator if dewatering activities continue at <br />the site? <br />9. Do you intend to place the topsoil and overburden stockpiles at the approved locations? <br />10. Do you intend to comply with all other aspects of the approved mining and reclamation <br />plans? <br />Currently, the decision due date is set for Apri119, 2004. If you cannot adequately address the <br />above noted concerns by the decision date, the application may be deemed inadequate and may <br />be denied unless you request an extension of the decision date. <br />If you have any questions, please give me a call at 303-866-4060.
