<br />3 <br />ENFORCEMENT ACTIONS FROM THIS INSPECTION: <br />The following Notice of Violations were issued by MLRD; <br />C-91-29 <br />C-91-30 <br />C-91-31 <br />C-91-32 <br />C-91-33 <br />C-91-39 <br />C-91-35 <br />C-91-36 <br />C-91-37 <br />C-92-O1 <br />In addition to the above enforcement which has already been taken <br />Ten-Day Notice number 92-02-352-001 iS being Sent t0 MLRD for <br />failure to require the mine to operate in compliance with the <br />approved permit. Specifically, a failure to require compliance <br />with the SPCC plan. The stoker oil tank containment wall is <br />broken and will not contain a spill should one occur. Pond #5 is <br />shown as a secondary containment structure, however it does not <br />have an oil skimmer to remove any oil which might end up in it. <br />In any case the block wall is the primary containment structure <br />for the tank and it must be maintained. <br />OTHER: <br />All of the above items which were identified above as violations <br />or potential violations were discussed at the close out meeting <br />between Energy Fuel S, MLRD and OSM. <br />MLRD was also notified that due to the holidays, this report and <br />any Ten-Day Notice resulting from this inspection would not be <br />completed until after January 1. <br />MSEIR: <br />Those items in block 23 of the Mine-Site Evaluation Inspection <br />Report form which were marked with a "2" have been discussed <br />above and those marked with a "3" were not applicable. <br />
