04004 Banks and Gesso, LLC <br />Exhibit M -Other Permits and Licenses <br />Additional permits and approvals required for the Fort Lupton Sand and Gravel Mine are <br />listed below. <br />Weld County Use by Special Review Permit <br />The applicant is applying for an amendment to its existing Weld County Use By Special <br />Review (USR) Permit #1255 to allow mining and related activities on the additional <br />properties. <br />Weld County Flood Hazard Development Permit <br />The applicant has obtained Flood Hazard Development Permit (FHDP) #355 from Weld <br />County for the existing operation. A new or amended FHDP will be obtained for the <br />amended permit boundary prior to commencing operations in the amendment area. <br />CDPS State Discharoe PermiUStormwater Permit <br />The applicant currently holds an approved CDPS/Stormwater Permit from the Colorado <br />Department of Public Health and Environment (CDPHE) that will be amended, if <br />necessary, to account for any changes to the location and/or amount of off-site <br />discharge resulting from this amended operation. However, no changes are anticipated. <br />Air Permits <br />The applicant currently holds approved Construction Permits from CDPHE's Air Pollution <br />Control Division for fugitive and processing operations. The fugitive dust permit will be <br />amended to account for the increased acreage. The processing permit will not require <br />an amendment, since the same equipment will be used to process material from the <br />additional parcels. <br />Road Access and Maintenance Agreements <br />The applicant currently has a Road Access and Maintenance Agreement with Weld <br />County Public Works for access onto Weld County Road 18 for the existing mining <br />operation. This Road Access Agreement will be modified prior to relocating the access <br />location. <br />A Substitute Water Supply Plan (Plan) for the existing operation was previously <br />submitted to the State Engineer's Office (SEO) and was approved on September 12, <br />2001. An updated Plan for the existing mining area has been prepared and submitted to <br />the SEO, and was approved in June 2004. The SWSP will be updated as necessary to <br />allow for exposure of ground water in the amendment area. New Gravel Well Permits <br />will also be obtained for each phase prior to the exposure of ground water. <br />Colorado Historical Society <br />Please see the results of a search of the Colorado Inventory of Cultural Resources in <br />Attachment C.
