~~ <br />EXHIBIT A <br />SCOPE OF WORK <br /> <br />This Scope of Work sets forth the work to be undertaken under the <br />terms of the Agreement for Environmental Consulting Services (the <br />"Contract") and the total costs associated with the work. The <br />purpose of the work is to provide independent oversight and review <br />of the monitoring conducted by Battle Mountain Resources at certain <br />monitoring locations associated with its tailings facility at the <br />San Luis Mine located in Costilla County, Colorado. The work will <br />consist of the review of relevant documents, preparation of certain <br />reports and guidelines, the oversight of sampling activities, the <br />analysis of samples obtained in the course of sampling activities <br />and the preparation of summary reports. The work will b$ conducted <br />in accordance with the terms of the Memorandum of Understanding <br />between BMRI and the DMG ("the MOU") and will consist of the <br />following specific activities: <br />Task 1. <br />Pre-Sampling Activities <br />Pre-sampling activities will include the preparation for <br />sampling at the site by the successful comple ion of the <br />safety training deemed appropriate and admitstered by <br />the Colorado Division of Minerals & Geology's Office of <br />Active Mines (previously "the Colorado D vision of <br />Mines"). The appropriate certification will a obtained <br />and maintained by the contractor for presentation upon <br />request. The Contractor will also complete whatever <br />safety indoctrination and/or training as may ]fie required <br />and administered by BMRI at its mine site. N cost will <br />be invoiced by the contractor for this mandate activity. <br />Task 2. <br />Preparation of Sampling Guideline <br />Contractor will prepare specific guidelines $or its use <br />in the conduct of the sampling activities. The <br />preparation of this guideline will include <br />familiarization with the monitoring required of BMRI in <br />the permit documents, familiarization with the sampling <br />and analytical protocol (TR-006), and the preparation of <br />a brief letter report summary of the Contractor's <br />sampling guideline. The guideline will be s~bmitted to <br />the DMG contract administrator for review a d comment. <br />The guideline will be revised appropriately n response <br />to direction from the DMG contract administrator. This <br />guideline will be provided to BMRI. i <br />
