.~ • ~~ • ~ <br />r <br />Notice of Violation No. 79-V-1-12 to SEI. Notice of Viola- <br />tion No. 79-V-1-12 contains the following alleged violations: <br />a. Alleged Violation No. 1. "Opening <br />or developing a site for surface coal mining <br />operations (which includes underground mines) <br />without a state permit, in violation of <br />30 U.S.C. 502(a)." <br />b. Alleged Violation No. 2. "Failure <br />to pass all surface drainage from disturbed <br />area through a sediment pond." <br />c. Alleged Violation No. 3. "Failure <br />to maintain access roads so as to prevent <br />the additional contribution of suspended solids <br />to stream flow. The main access road has not <br />been scraped & has mud in excess of 4" deep <br />& runoff water leaving road has entered <br />into the natural drainage." <br />d. Alleged Violation No. 4. "Failure <br />to post a mine permit & identification sign." <br />e. Alleged Violation No. 5. "Failure <br />to maintain diversion ditch so as to prevent <br />additional contributions of suspended solids. <br />The sides of the diversion have slumped into <br />stream flow and small piles of coal have been <br />deposited into channel of the diversion." <br />f. Alleged Violation ido. 6. "Failure <br />to salvage topsoil prior to surface disturbance <br />[on the parking pad site]." . <br />3. Since the commencement of its activities at <br />McClane Canyon, and prior to May 10, 1979, SEI had maintained <br />close communication with the USGS, the Bureau of Land Manage- <br />ment ("BLM") and the state regulatory authority, the Colorado <br />P4ined Land Reclamation Division, Department of Natural <br />-2- <br />
