("SEI"), by and through <br />its attorneys, Holland & Hart, hereby applies for review of <br />Notice of Violation No. 79-V-1-12, dated May 10, 1979, issued <br />by an inspector for the the Office of Surface Mining ("OSM"), <br />Region V. In support of its Application for Review, SEI <br />shows the Office of Hearings and Appeals the following <br />facts and requests the following relief: <br />STATEMENT OF FACTS <br />1. SEI, a California corporation, has been con- <br />ducting underground coal exploration operations on federal <br />coal deposits leased to SEI [Federal Coal Lease tdo. C-0125439) <br />at its McClane Canyon Exploration Site, Garfield County, <br />Colorado, since prior to the passage of the Surface Mining <br />Control and Reclamation Act of 1977 ("SMCRA") Exploration <br />operations have been conducted pursuant to an exploration <br />plan approved by the United States Geological Survey ("USGS") <br />in November, 1976, effective December 1, 1976, as amehded. <br />2. On May 9, 1979, Thomas E. Ehmett, an inspector <br />for the OSM, Region V, visited SEI's McClane Canyon explora- <br />tion operation. On May 10, 1979, Inspector Ehmett issued <br />
