3: The recalculated Financial Warranty for the above referenced TR is now set at
S41,000.00 if the disturbance exceeds the maximum 10 acre commitment. The
operator cannot disturb any areas outside of the approximately 10 acres currently in
Phase 1 until the new bond is accepted by the Division. The current bond of
517,000.00 will be sufficient so long as the 10 acre commitment is kept.
Failure to uphold any of these 3 conditions will result in a violation being issued and
possible permit revocation and / or civil penalties being accessed by the Mined Land
Reclamation Board.
All other portions of the approved permit are still in effect and unchanged at this time.
Please note that under normal circumstances TR's usually take the entire 30 days to
review and receive a decision. Staff expedited the review of this TR to assist the operator
and contractor, but the Division cannot normally do so in such a short time frame.
If you need additional information, please contact me at the Division of Minerals and
Geology, Grand Junction Field Office, 101 S. 3rd St., Suite 301, Grand Junction, Colorado
81501, telephone no. 970.241.1 1 17.
Sincerely,
~. ~'~~
G.
