Cottony <br />Acring Division Director <br />Paonia, CO 81428 <br /> ~- <br />Re: Nigh Mesa Grave/ Pit, Permit No. M-2000-067, Technica/ Revision (TR-021 Approve/. <br />Dear Mr. Beavers: <br />Staff has received the clarifications requested for the review of the Technical Revision (TR) <br />request (TR-02) to allow a hot and cold batch plant to operate on site and conditions for <br />reconfiguring Phase 1 from 10 to 18 acres. Per Beavers Construction instructions <br />resulting from the miscommunication between all parties involved in the original submittal <br />of this TR, staff has waited until it received written verification from Beavers to proceed. <br />This Office received the required written verification on May 23, 2003 with the following <br />stipulations: <br />(1) The operator affirms the commitment to the maximum of 10 acres of disturbance as <br />perTR-01. <br />(2) If additional disturbance is necessary, the operator will be required to post the <br />additional bonding noted below, prior to env disturbance beyond the 10 current <br />acres. <br />Therefore, the Division of Minerals and Geology is approving TR-02 which: <br />1: Expands Phase 1 from 10 acres to 18 acres. But still limits total disturbance to 10 <br />acres. <br />2: Allows for the set-up and operation of a temporary cold and hot batch plant. Any <br />storage containers for hazardous or petroleum materials will be placed in secondary <br />containment structures as described in the TR request. This Office is to be notified <br />prior to the start up of the plants so staff may inspect to ensure compliance with <br />secondary containment and disturbance requirements. <br />
