Most of the <br />exhibit materials appear to adequately address the amendment application requirements, but there aze a few items <br />that need further clarification. I have listed these items in the paragraphs below under the exhibit headings to which <br />they pertain. Please arrange your responses in the same order to facilitate our review. Exhibits not mentioned in <br />this letter are considered to be adequate at this time. <br />Exhibit A -Legal Description (Rule 6.4.1) <br />This is a note of clarification about this exhibit: the oversized sheet containing the legal description of the azeas <br />comprising the 44.00 acres to be added under this amendment also contains the legal description of other tracts <br />totaling another 17.49 acres. These other acres appeaz to consist of 16.59 acres of processing azea and 0.90 acre of <br />river crossing, both of which areas aze akeady included in the permitted acreage. No other accounting of presently- <br />permitted acreage is presented in the legal description or map, though the permit azea includes a significant amount <br />of additional azea. The in-stream mining portion of the acres still remains in the permit, and this pazagraph seeks to <br />clarify that (1) none of the in-stream acres have been released from the permit, even though they do not appeaz on <br />the legal description, and (2) that only the 44.00 acres first identified comprise [he actual area to be added under <br />this amendment. No response is needed. <br />Exhibit C -Pre-mining and Minine Plan Mans (Rule 6.4.3) <br />The mining plan map does not contain any indication of the direction of mining, though it is requued. This should <br />be added. Since this is a phased operation (as described under Exhibit D) it might be helpful to depict the site at a <br />point when it is partially mined, showing all final vs temporary slopes, roadways, etc., as pertinent to the operation. <br />Neither the pre-mining nor mining plan map contains a labeled pem3it azea boundary. The in-stream extraction <br />portion of the permitted area is not shown. There is no delineation of the rest of the existing permitted azea, <br />differentiating it from the area to be added under this amendment. These items should be added. <br />Please be reminded that the revised map should also include a signature and date. <br />Exhibit D - Minine Plan (Rule 6.4.4) <br />The site will be mined in two-acre strips by first removing topsoil, then dry-mining down at partial depth, then wet- <br />mining down to full depth. Excess topsoil will be spread permanently on the off-permit pasture azeas, which is <br />acceptable. Topsoil that is needed for final reclamation of the pond slopes (above high water elevation) will be <br />stockpiled azoand the perimeter of the pond. Please commit to ensuring that (1) sufficient topsoil is salvaged to <br />perform the reclamation at any point during the operation (which may include some dry-mined acres), (2) all <br />Office of ~ Office of Colorado <br />
