On <br />Wednesday, July 16, 1997, I spoke on the telephone to Mr. Doug Frazier, an adjacent <br />landowner of the Bowie No. 2 Mine in Paonia, Colorado. Mr. Frazier owns a home, an <br />orchard and some rental property just to the south and down gradient of the mine. He told <br />me that the dust from the mining operations was coming onto his property. He further <br />stated that the dust problem was very bad between 5 pm and 6 pm, and that this has been <br />going on for the last three weeks. He commented that other landowners in the immediate <br />area have also had problems with the Bowie No. 2 dust. He requested that this Division <br />do something about the dust. I told him that I would contact the mine operator directly. <br />I called Bill Bear Jr. of Bowie Resources Ltd., the contact person for the Bowie No. 2 <br />Mine, but he was out of the office. Therefore, I talked to Basil Bear, the contact person at <br />the Bowie No. 1 Mine. I informed him of the landowners concern. Basil Bear said he <br />would get on it right away. I mentioned that the problem should be solved quickly and <br />with certainty. Mr. Bear agreed. I left a voice mail with Mr. Frazier, letting him know of <br />the mine operator's statement and that if the problem is not resolved, to give me another <br />call. <br />On Monday, July 21, 1997, Mr. Frazier called me and informed me that the dust problem <br />still had not been resolved and that there was a new problem with the effects of blasting, <br />namely, rock debris falling on his property. I asked Mr. Frazier to write all of this in a <br />
