and may, if time permits, make oral and/or written presenta- <br /> tions on any subject within the Board' s jurisdiction. " Rules <br /> and Regulations, Rule 1. 28 , (emphasis supplied) . Rules 1. 23 <br /> and 1. 28 serve to define Plaintiffs' status in the adminis- <br /> trative proceeding as interested persons objecting to the <br /> Nottingham application who were allowed to appear and,make <br /> an oral presentation at the March 1, 1979 Board meeting. <br /> This procedure is entirely consistent with the licensing <br /> provisions of the Administrative Procedure Act which provide <br /> that " . . . the agency, with due regard for the rights and <br /> privileges of all interested persons shall set and conduct <br /> the proceedings in accordance with this article. " Section <br /> 24-4-104 (1) , C.R. S. 1973. <br /> In contrast, Rule 2. 36 of the Rules and Regulations <br /> provides that if the Board holds a hearing in response to a <br /> properly submitted request for hearing , such proceeding shall <br /> be conducted in conformance with the requirements of Section <br /> 8. 24 . That section of the Regulations provides that: <br /> "If a hearing is set pursuant to the <br /> provisions of this section, it shall be open <br /> to the public and conducted in accordance <br /> with the provisions of the State Administra- <br /> tive Procedure Act, Article 4 of Title 24 , <br /> C.R. S. 1973. The Board shall permit all <br /> parties to respond to the notice served , to <br /> present evidence and arguments on all issues, <br /> and to conduct cross examination required for <br /> a full disclosure of the facts. " Rules and <br /> Regulations, Rule 8 . 24 (emphasis supplied) . <br /> The adjudicatory hearing provisions of the Administrative <br /> Procudure Act also refer to "parties" rather than "interested <br /> persons" . . [ "In order to assure that all parties to any agency <br /> proceeding are accorded due process of law, the provisions <br /> of this section shall be applicable. " Section 24-4-105 (1) , <br /> C.R. S. 1973] . It is particularly significant that the <br /> Administrative Procedure Act provides a specific mechanism <br /> by which an interested person can obtain party status: <br /> "A person who may be affected or aggrieved <br /> by agency action shall be admitted as a party <br /> to the proceeding upon his filing with the <br /> agency a written request therefor, setting <br /> forth a brief and plain statement of the <br /> -8- <br />
