Exhibit Page 51 <br /> not damage towers, foundations, or cables. <br />Evaluation By establishing a 200-foot setback around the two towers which are inside the <br /> permit area, and ensuring that no activities on the permit area are within 200 feet of <br /> the towers not in the permit area, assuming a maximum of 30 feet in working face <br /> height, assuming an angle of repose of 37 degrees (that of loose sand and gravel}, <br /> and using backfill to create slopes not greater than 3H:1 V around the 200-foot radii <br /> of the towers, there will be no potential for impact on the power lines. Since mining <br />' will use bucket (front-end) loaders, dozers, and other similar equipment, the only <br /> other prohibition necessary to prevent potential conflicts with use will be to prohibit <br /> erection of any processing plants or stockpiles within 100 feet of the centerline of the <br />' powerlines. <br />Structure Descriptionlnotes Owner <br />Barbed-wire Various 3- and 4-strand barbed wire fences are located on LMN Properties <br />' fencing the property, including the perimeter. (Landowner} <br />Evaluation The lease for both Four States Aggregates and Montezuma County requires that the <br /> fences be maintained and if necessary replaced if no longer serviceable due to <br /> mining operations. In addition, both Four States Aggregates and Montezuma <br /> County have a direct interest in maintaining fence serviceability to prevent cattle <br /> from overgrazing areas being reclaimed. Based on soil conditions, no impact is <br /> expected on fences, as based on past mining near fencing. Therefore, there <br />' appears to be no need for detailed analysis or for an additional compensation <br /> agreement beyond the leases. <br /> NOTE: Although the fence line just south of the permit boundary is identified by the <br />' surveyor as being on the property of Lloyd Wallace, Mr. Wallace and Laveena <br /> Saunders (LMN Properties) agree that the proper boundary is the fence line and that <br /> the fence is the property and responsibility of LMN Properties. <br />Structure Descriptionlnotes Owner <br />Roads Existing roads include roads improved and to be LMN Properties <br /> maintained to county standards (as provided in the lease (Landwoner) <br />' agreements), and older roads and trails (pre-mining) to be <br /> replaced by county-standard roads as directed by the <br /> landowner as part of reclamation work. <br />' Evaluation <br />Structure Description/notes Owner <br />Cabin & A small hunting/recreational cabin is located inside the LMN Properties <br />' <br />outbuildings permit boundary but more than 200 feet from any land (Landowner) <br /> proposed to be affected by mining operations. <br />Evaluation By keeping all mining activity more than 200 feet from these properties, and meeting <br />' requirements for storm water management, no impact on these properties is <br /> anticipated.
