Long <br /> Division Dnecior <br />FROM: Erica Crosby <br /> Larry Routten <br />RE: Seneca II-W Mine (C-82-057) <br />NOV C-95-023 <br />Extension of Abatement Deadline Beyond 90 Days <br />Please find attached, Seneca Coal Company's request to extend the abatement deadline <br />beyond 90 days for NOV C-95-023. The violation was issued October 16, 1995. The first <br />90 day period ended January 14, 1996. The violation abatement due date was first extended <br />to April 13, 1996, then to July 12, 1996 and finally to October 10, 1996. Abatement <br />requirements for the violation included submittal of a technical revision (TR), and field <br />implementation of the designs approved in the TR following final approval by DMG. The <br />revision was approved on August 26, 1996. Seneca has initiated work on the abatement plan <br />by removing topsoil over the area which needs to be regraded. Seneca still needs to reduce <br />the slope back to a 3:1, replace the topsoil and revegetate the redisturbed acreage. <br />Rule 5.03.2(2)(c) list five circumstances which may qualify a surface coal mine for extension <br />of the abatement of deadline beyond 90 days. The revision was approved on August 26, <br />1996 and the public comment period ended in the middle of September. This did not leave <br />Seneca enough time to complete the work to abate the violation.
