<br />-2- <br />NOTICE OF VIOLATION <br /> <br />Based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />Raul Vasquez and Blue Mountain Stone Co. to be in violation of Permit <br />M-81-107, C.R.S. 34-32-116(7)(h) of the Colorado Mined Land Reclamation Act. <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Raul Vasquez and Blue Mountain Stone Co. to: <br />1. Cease and desist from conducting the following mining operations at the <br />Beech Hill Quarries - Permit M-81-107: cease and desist from adding any <br />additional rock or materials to all areas outside the permit boundary. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1> of <br />this Cease and Desist Order. <br />3. Complete the following corrective action: <br />a. Submit a complete conversion application to a 112 permit to the <br />Division which includes all areas disturbed outside the permit <br />boundary by February 16, 1993. <br />b. Obtain an approved conversion to a 112 permit from the Division <br />which includes all areas disturbed outside the permit boundary by <br />May 16, 1993. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the <br />amount of $3,000.00. Payment of the civil penalty will be held in abeyance <br />until the February, 1993 Mined Land Reclamation Board meeting. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />
