Schwarz, Esq. <br />Massey Semenoff Schwarz & Bailey, P.C. <br />730 17`h Street, Suite 330 <br />Denver, Co 80202 <br />RE: Engineers Report for Division of Minerals and Geology on May 5`h Riverbank Failure <br />along South Platte River <br />Dear Mr. Schwazz: <br />Applegate Group, Inc. has completed our investigation of the failure of the riverbank <br />adjacent to the South Platte River located at the Northwest comer of the Mobile Premix <br />Concrete, Inc. Howe mine site in Adams County Colorado. It is our understanding, from <br />information provided to us by staff at the Urban Drainage and Flood Control District <br />{"UDFCD"), that [he levee failed sometime during the afternoon and evening of Saturday <br />May 5`h after being subjected to a flow of approximately 6000 CFS. The failure caused a <br />significant portion of the South Platte River to flow through what is commonly known as <br />the Bull Seep Slough, which is located immediately north of and on portions of the Howe <br />Pit property. See Figure 1-1 for reference to these locations. <br />On Wednesday June 13, 2001 we attended a meeting with you and representatives of <br />Mobile Premix that was held at the UDFCD's offices. Mr. Tom Schreiner of the Division <br />of Minerals and Geology was also present. The main focus of the meeting was to assess <br />the primary cause of the May 5, 2001 flow event and the damage caused by the event. <br />Urban Drainage personnel and Ken Macintosh (a local adjacent property owner) expressed <br />the opinion that the failure was caused by the proximity of the northern portions of the Bull <br />Seep to the South Platte River. <br />We conducted a site visit after [he meeting on June 14`h 2001 with John Hickman of <br />Mobile Premix and on June 18`h 2001 with Mr. Brian Kohlenberg from UDFCD. As <br />Applegate Group, Inc. is frequently onsite, it was apparent that a portion of the roadway <br />along the North boundary of the mine site had suffered some damage to erosion from the <br />May 5 flow event. It was also apparent that a flow had passed through the Bull Seep <br />Slough and removed some existing vegetation.
