The Hawks Pit (United/Norwood Pit) was reduced to 9.72 acres by a technical revision <br />in 1994. The permit remained improperly a section 112 permit operation. This <br />section, which only applies to operations over 10 acres in size, improperly enabled this <br />application to be processed as a permit amendment instead of a conversion. However, <br />under Rule 1.11, the applicant would not be able to apply for a conversion, until he has <br />he]d the permit for at least two (2) years. <br />2. The original 112 Conversion was done illegally, because the Town of Norwood, which <br />is located under two (2) miles from the proposed operation, has not been notified. <br />There is no proof that Montrose County was notified, and there is no evidence the <br />application was placed at the Office of the Montrose County Clerk and Recorder. <br />If you have questions, please give me a call. <br />Sincerely, <br />Larry D.
