'~ <br /> <br /> <br />-z- <br />The specific provisions that have been violated are, for Permit Number <br />80-233: <br />1. Those conditions, recitals and agreements which state that the <br />proposed mining and reclamation operations can be carried out in conformance <br />with the requirements of the Act (the Mined Land Reclamation Act, C.R.S. <br />34-32-101 et se .) and that the operator agrees to be bound by all applicable <br />requirements of the Act and all applicable rules and regulations of the Board, <br />as amended from time to time. <br />The term "operator" is defined by C.R.S. 1973, 34-32-102 to include; any <br />person, firm, partnership, association or corporation, or any department, <br />division, or agency of federal, state, county or municipal government engaged <br />in or controlling a mining operation. <br />CEASE AND DESIST ORDER <br />Based upon the foregoing Findings of Fact and Notice of Violation, and <br />pursuant to the provisions of C.R.S. 1973, 34-32-124, the Board hereby orders <br />you to: <br />1. Immediately cease and desist all mining operations. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined <br />land Reclamation Board, written notice of your compliance with paragraph one <br />(7) of this Cease and Desist Order. <br />In clarification of the rights of recipients of Notices of Violation, <br />Cease and Desist Orders, parties are advised to consult the Colorado Mined <br />Land Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain <br />acts to be performed within a certain time, shall be construed as a permit or <br />license to engage 1n any prospecting or mining operations within the State. <br />Persons concerned with ,]udtcial review of the provisions of this Order <br />are advised to consult C.R.S. 1973, 24-4-106, as amended. <br />Dated at Denver this ayt~fday of <br />/ep <br />Doc.
