~~ ~ • ' <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE NATTER OF: ) NOTICE OF VIOLATION MV-84-006 <br />Pueblo Paving, Inc. ) ANO <br />CEASE AND DESIST ORDER <br />T0: Pueblo Paving, Inc. and all other persons engaged in or owning or <br />controlling the following operation: Mining operations described under Mined <br />Land Reclamation Board Permit Numbers BO-233 and 80-246. <br />FINDINGS OF FACT <br /> <br />Pursuant to the authority vested 1n the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 1973, 34-32-124, as amended, the Board hereby <br />makes the following findings of fact: <br />1. Pueblo Paving, Inc. 1s conducting mining operations in the following <br />locations: as described in the legal descriptions undeG Mined-Land -- - <br />Reclamatlon Board Permit Numbers 80-233 and 60-246. <br />2. Pueblo Paving, Inc. has failed to maintain adequate financial <br />warranties for Permit Numbers 80-233 and 80-246. <br />Financial Warranties for both permits have been cancelled by the surety, <br />a fact of which you were notified to correspondence from Michael Stanton dated <br />October 13, 1983. <br />NOTICE OF VIOLATION <br />You are hereby notified that the facts stated above constitute a <br />violation of Permit Numbers 80-233 and 80-246. <br />The specific permit provisions that have been violated are, for Permit <br />Number 80-246: <br />1. Recital C, paragraph 1, beginning at the bottom of page 1 and <br />Recital C; paragraph 3 nn pane 2; ~+~Pe.rmit_Number->10-24b~s.surd ta~out-s -_ <br />company-on February 28, 1S87; ~-- - -- -- <br />2.
