"~ ~ • <br />• Phase I Bond Release - 12/18/95 <br />- DMG retained sufficient bond to cover remaining <br />maintenance and pond removal <br />- Following Phase I bond release, the operator has <br />an additional 10 yeazs of liability during which <br />they are responsible for: <br />- site maintenance <br />- sediment pond removal <br />- NPDES monitoring <br />- maintaining insurance on the site <br />• Recent inspections -site stable <br />• History Leading to This Hearing <br />• In conversations with the DMG, beginning in 1995, Twin Pines <br />Investment, Inc. (TPI) indicates that they may not be able to <br />continue to maintain the mine for financial reasons. <br />Reclamation was, however completed prior to TPI issuing <br />formal notice of inability to comply. <br />• April 9, 1996 - NOV's C-96-007 and C-96-008 issued for failure <br />to perform hydrologic monitoring in accordance w/approved <br />plan and failure to make records available in location near the <br />mine, respectively. <br />• April 16, 1996 - In phone conversation w/DMG, TPI indicates <br />inability to abate violations or continue to maintain the <br />site> > > DMG issues Cessation Order C-96-009. <br />• April 17, 1996 -DMG receives letter from TPI indicating <br />inability to comply w/terms of cessation order. <br />• April 19, 1996 -DMG issues "Order to Show Cause Why <br />Permit Should Not be Revoked:' <br />• April 29, 1996 -DMG receives letter from TPI requesting a <br />review of the Show Cause Order before the Board. TPI does <br />not wish to contest the order, but does wish to explain why TPI <br />is unable to continue maintaining the site. <br />
