It appears that the proposed <br />maximum disturbance may be too small since most of what is presently disturbed will <br />likely remained disturbed even as mining progresses into the newly designated panels. <br />By reviewing the plan it is not cleaz that any of the cusently disturbed azea can be <br />reclaimed as the new panels are developed. Please review the total disturbed acreage and <br />submit any corrections. Once these are received the reclamation costs will be calculated <br />for the entire operation. <br />6.4.13 EXHIBIT M -Other Permits and Licenses <br />Any comments that we have received from other agencies are enclosed with this letter. <br />6.4.14 EXHIBIT N -Source of Letal Rieht to Enter <br />This section is adequate as submitted. <br />6.4.15 EXHIBIT O -Owner(s) of Record of Affected Land (Surface Area) and <br />Owners of Substance to be Mined <br />This section is adequate as submitted. <br />6.4.16 EXHIBIT P -Municipalities Within Two Miles <br />Please provide the mailing address for the Town of Alma as required by Rule 6.4.16. <br />6.4.17 EXHIBIT Q -Proof of Mailine of Notices to County Commissioners and Soil <br />Conservation District <br />This section is adequate as submitted. <br />6.4.18 EXHIBIT R -Proof of Filine with County Clerk and Recorder <br />This section is adequate as submitted. <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />Rule 6.4.19 states- "Where the mining operation will adversely affect the stability of any <br />significant structure located within 200 feet of the affected land, the applicant may either: <br />(a) provide a notarized agreement between the applicant and the person(s) having an <br />interest in the stmcture, that the applicant is to provide compensation for any damage to <br />the structure; or <br />(b) where such an agreement cannot be reached, the applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation. <br />
