C-84-065 MR 19 <br />Page 3 of 4 <br />*Ruie 2.08.4(5) Application requirements. An application for all types of revisions or a permit <br />shall contnin: <br />*Ruie 2.08.4(5)(a) An identification ojthe permit by permit number or other nppropriote reference <br />which is the subject of the revision; <br />The application is incompliance with this rule. A cover sheet to the application correctly identifies <br />the permit as C-84-065. <br />*Ruie 2.08.4(5)(b) A specific description of the requested change in the terms of the permit; <br />The application is in compliance with this rule. A reference to revised pages to the permit provides <br />a description of the requested changes in the terms of the permit. <br />*Ruie 2.08.4(5)(c) A specific description of any changes in the mining and reclamation operation <br />which may have an effect on performance bond requirements of Rule 3; and <br />The application is in compliance with this rule. There is no effect on [he performance bond <br />requirements. The cover sheet of the application indicates no change. <br />*Ruie 2.08.4(5)(d) Such other information as may be necessary for the Division to determine if the <br />proposed revision wit! comply with the Act and these Rules. The Board or Division may reasonably <br />request additional information to evaluate the proposed revision. <br />The application is incompliance with this rule. Information in the application is complete. <br />Rule 2.08.4(6)(c)(ii) Within 10 days after the filing of a complete application for a minor <br />revision, the Division shall issue a decision approving or denying the application in whole or in <br />part. A written copy ojthe decision shall be promptly provided to the permittee and shall be <br />posted in the Division office. <br />A proposed decision date of May 6, 2002 was posted on May 6, 2002. A written copy of the <br />proposed decision was sent to the permittee by Division letter of May 6, 2002. <br />Rule 2.08.4(6)(c)(iii) Within 10 days after the notification required by 2.08.4(5)(c)(ii) above, any <br />person which has an interest which is or may be adversely affected may request a formal hearing <br />on the decision by the Division. Strch request shall be in writing and slate with reasonable <br />specificity the reasons for the request and objections to the Division. If so reyt~ested, the formal <br />hearing shall be conducted in accordance with [he requirements of 2.07.4(3). <br />The public notice of Rule 2.08.4(6)(c)(ii)ahove was posted. There were no comments in <br />response to the public notice. <br />
