C-84-065 MR l9 <br />Page 2 of 4 <br />closure 7 June 02 <br />A public notice of the proposed decision was posted on May 6, 2002, closed on May 16, 2002. <br />There were no responses to the notice. A closure letter of June 7, 2002 was sent to the applicant. <br />Changes to the Permit Application Package (PAP) are the following revised and added pages: <br />Pa a Number Date <br />2-8 2/021 <br />Exhibit 2.4-2 Access and Surface Use A Bement, 3 a es <br />This compliance review is a two step process. The first is for completeness of the filing, the <br />second for compliance for a proposed decision. Rules that apply for completeness are indicated <br />with an asterisk (") and include: 1.04(73), 2.07.3(1), 2.08.4(3), 2.08.4(5), 2.08.4(5)(a), <br />2.08.4(5)(b), 2.08.4(5)(c), and 2.08.4(5)(d). <br />*Rule 1.04(73) "Minor revision"means a modification in pennit provisions to reflect minor <br />alterations in [he location of roads or other facilities within the permit area, minor alterations in <br />the timing or sequencing ojmining or reclamation plans approved in accordance with the <br />requirements ojthese Rules or other minor alterations in surface coal mining and reclamation <br />operations which shall no! cause a signifrcant alteration in the permittee's reclamation plan. <br />The application is appropriate to this rule as the requested change is to insert pages that have <br />already been approved in the PAP. <br />*Rule 2.07.3(1): Upon submission of an application for permit or revision or renewal thereof, <br />the Division shall, within l0 days of receipt ojsaid application, review the submission and <br />determine if it is complete. ~ /jthe application is complete, the applicant shn11 be duly notified <br />and the application shall be considered fried for purposes ojthe Act. /jthe application is <br />incomplete, notice to that effect steal! be mailed to the applicant within said 10-day period, and <br />the applicant shat! be given the opportunity to amend, review, or otherwise make .said <br />application complete. <br />~ The Application was found complete on May 6, 2002. See Rule 2.08.4(5)(a), (b) and (c) below <br />for the criteria for this determination. <br />Z Not applicable to a determination of completeness. <br />*Rule 2.08.4(3) See the Rules for the text of this rule. <br />The proposed action was determined to be appropriate to a minor revision [Rule 1.04(73)]. <br />
