Long <br />Division Director <br />Division of Mines and Geology <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Dear Mr. Long, <br />March 8, 1995 <br />Mi Vida Enterprises received your certified letter regarding the Gold Hill Mill dated <br />February 28, 1995, yesterday, <br />This letter is formal notice that Mi Vida Enterprises will not conduct milling operations <br />at the Gold Hill Mill until the corrective actions required by the Mined Land Reclamation <br />Board have been completed to the satisfaction of the Division staff. <br />As you know from our previous meetings and discussions, Mi Vida Enterprises has not <br />had anything to do with the milling operations conducted by Colina Oro Molina (COM, Inc.) <br />since Mr. J. Wayne Tatman took possession of the site on October 23, 1990. Under the terms <br />of the Milling Contract between COM, Inc. and Mi Vida Enterprises dated February 13, 1991, <br />COM, Inc. assumed responsibility for complying with all governmental permits, approvals, <br />~ and regulations governing its milling operations at the Gold Hill Mill. So long as the Milling <br />Contract is in force and effect, COM, Inc. has access to the surface of the White Cloud and <br />Wynona mine claim group for the purpose of disposing of tailings in the tailings pond and for <br />storing water underground in the Hazel A., Wynona, and Times mines. COM, Inc. is <br />supposed to diligently comply with any and all legal or permit requirements for the use of <br />these water storage rights and the tailings pond. Under the terms of this Agreement, COM, <br />Inc. is also obligated to plan for the construction of additional tailings pond capacity to <br />standards required by applicable laws, regulations, and permits. Mi Vida Enterprises is <br />required to contribute the land surface for new tailings pond construction on its mining claims <br />that are reasonably near the existing pond and physically and topographically suitable for this <br />MAR d 9 1995 <br />Division of rvunerais a Geolo9Y <br />1 <br />
