This policy allows <br /> the small amount of inadvertently affected land to be exchanged for an equal amount of <br /> undisturbed affected land that will be deleted from the permitted affected land area. Although <br /> this policy handles this situation as a TR submittal, the public notification procedures required <br /> for an amendment (Rule 1.6.2) must be followed. Additionally, Henderson must waive the right <br /> to a 30 day TR decision as per Rule 1.9.1, and must agree that the TR automatically will become <br /> an amendment in the event that any adverse public comments are received in writing within the <br /> comment period. Should the latter occur, Henderson must file the remainder of the standard <br /> amendment fee within 15 calendar days of the objection. All information regarding public <br /> notification and publications is found in Appendix C. <br /> The approved amendment to which this TR applies as well as the original permit is included by <br /> reference. <br /> • 3.0 THE TECHNICAL REVISION <br /> 3.1 Temporary Road Segments—Affected Lands Exchange <br /> During construction activities in 1998, two short access roads were inadvertently constructed that <br /> were not included in the original permit amendment. Both of these road segments were <br /> constructed on lands owned by Henderson that were not included within the 53.36 acres of new <br /> affected land. Neither of these extraneous disturbances involved lands managed by the U.S. <br /> Forest Service. These road segments are labeled as the north and south segments, respectively <br /> and are located on the Figure 1 map. <br /> The north segment, located at approximately station 150+00, is 500 feet in length and <br /> approximately 30 feet in width. For purposes of the affected land exchange, a width of 75 feet is <br /> used to calculate a total affected acreage of 0.86 acre. This road segment was constructed in a <br /> manner similar to the approved access roads. A bulldozer and scraper were used to remove <br /> salvageable topsoil material to one of the topsoil stockpiles, and the roadbed was compacted. A <br /> silt fence was installed on the down-slope side to minimize erosion.
