Henderson 2000—PC3 Ove*d Surface Conveyor • <br /> Technical Revision #7 to Permit M-77-342 Page 5 <br /> . • The 2 acres to be deleted from the existing Henderson permit area have not been <br /> disturbed by either the existing operation or any previous operator where a succession of <br /> operators has occurred. <br /> • The existing reclamation plan, post mining land use (rangeland, wildlife habitat, and <br /> industrial commercial), and financial warranty amount are appropriate and adequate for <br /> the 1.43 acres to be added. <br /> • The total affected acreage to be added is less than (by 0.57 acre) the acreage to be <br /> deleted. <br /> The following process, as dictated in the DMG policy, has been or will be followed: <br /> • A standard request for a reclamation liability release for the 2 acres of land to be deleted <br /> from the Henderson permit was submitted to DMG on March 12, 1999. <br /> • In Appendix D of this TR, Henderson is submitting an amendment application form, a <br /> • new Exhibit A and a revised Exhibit N (source of legal right to enter). Figures I and 4 of <br /> the TR are the pertinent maps. <br /> 3.1.3 Proposed Acreage for Deletion <br /> The 2.0 acres of land the Henderson proposes for deletion from the present permitted affected <br /> land area are shown on Figure 4. The legal description of this land is: Unsurveyed portion upper <br /> Lost Creek, Henderson Exchange Survey #375, T2S, R78W. <br /> Presently, this small area is undisturbed and has a primary land use of open range and wildlife <br /> habitat. It is owned by Henderson and is located along the southeast side of upper Lost Creek. <br /> 3.1.4 Financial Warranty <br /> As discussed, this affected land exchange results in a net deletion of 0.57 acres of affected land <br /> from the Henderson permit area.
