Banta. <br />Division Director <br />Mr. Vance Mills <br />Trinidad Basin Mining, Inc. <br />HC-81, Box 6 <br />Barbourville, KY 40906 <br />RE: Trinidad Basin Mine (C-81-048) Bond Forfeiture Hearing <br />Dear Mr. Mills: <br />This letter is written as a follow up to the November hearing of the Colorado <br />Mined Land Reclamation Board. As you know, the hearing was a continuance of <br />the September and October hearings which were hela to discuss bond forfeiture <br />for the Trinidad Basin Mine because of failure to perform reclamation <br />obligations. In September it was determined that the main reason for TBM not <br />conducting reclamation maintenance was a problem accessing the property. <br />During that Board meeting it was decided that the hearing would be extended <br />while the Division intervened on behalf of TBM to try and obtain access to the <br />site, The Division contacted the land owners and both agreed to allow access <br />to TBM to perform reclamation maintenance. During the November Board meeting <br />the Board was informed that the access issue was resolved. The Board issued a <br />"Board Order" which allows TBM six months (until May 31, 1991) to perform the <br />required reclamation maintenance activities. If the required activities are <br />not undertaken the bond will be automatically forfeited. The "Order" <br />contained a list of maintenance items which need to be completed prior to <br />May 31, 1991, Following is a more detailed description of the list: <br />1. There are several settlement cracks which have occurred on the backfilled <br />areas which need to be filled in and re-compacted. Also, any rill or gully <br />which has formed in the backfilled areas which is larger than eight (8) inches <br />also needs to be filled in, compacted and re-seeded <br />2. Back filled areas that have slumped will need to have the "slumped" <br />material repositioned, compacted and re-seeded into the side slopes where <br />slumping has occurred. <br />
