Long. <br />Division Director <br />RE: Trinidad Basin Mining Co., Trinidad Basin Mine, Permit No. C-81-048, <br />Pattern of Violations <br />NOV C-91-009 was issued during the July 22, 1991 inspection for failure to perform all of <br />the maintenance items previously ordered by the Board. The items that had been <br />performed by the time of the inspection were: (1! repairing of settlement cracks, (21 filling <br />in of rills and gullies and (3) repairing or roads. The unattended items included failure to <br />direct all disturbed area drainage through a sedimentation pond and failure to address <br />maintenance of certain sedimentation ponds, diversion ditches, and culverts. The <br />remaining items were addressed prior to a follow-up inspection on September 13, 1991 <br />during which the work was reviewed and the NOV terminated. <br />NOVs C-92-013 and C-92-014 were issued during the June 29, 1992 inspection. This <br />inspection was originally scheduled to evaluate vegetation successes. During the <br />inspection, however, a brief, intense thunderstorm produced runoff that resulted in <br />permanent impoundment 15-P1 discharging water that later proved to be out of <br />compliance. Following the review of the water analysis, NOV C-92-013 was issued. <br />Additionally, aberm/ditch surface water conveyance system had also failed, allowing <br />untreated surface runoff to flow into Delagua Creek. As a result, NOV C-92-014 was <br />issued. <br />The abatement dates for NOV C-92-013 were August 15, 1992 for impoundment <br />maintenance and September 1, 1992 for P.E. certification. Wet weather has delayed <br />impoundment cleanout, so the NOV abatement dates have been since extended. The <br />abatement date for NOV C-92-014 was August 1, 1992. The August inspection revealed <br />that the work done was inadequate. These two NOVs will be the subject of a forthcoming <br />NOV Assessment Conference. <br />NOV C-92-020 was issued for failure to maintain sufficient capacity to contain a 10-year, <br />24-hour event within Pond 15-P11. The water level in the pond was up to the emergency <br />spillway, but only a trickle (1/4 gpm) was discharging through the primary spillway, <br />indicating the primary spillway had been clogged or closed. Water samples were taken, <br />and we are awaiting the results. <br />NOV C-92-021 was issued for failure to maintain the principal spillways of permanent <br />impoundments 15-P1, 15-P2, 15-P20 and 22-P17.
