WOODS: The testimony has been that he mined <br />40 days without a permit. <br />I would like to ask him to respond to it. I thought <br />we asked him that question in May of some length. I think <br />there is considerable testimony. <br />CHAIRMAN TURNER: I thought we already decided on <br />the violation. <br />MR. BLACH: What did you recommend, Jim, for civil <br />penalty? <br />MR. McARDLE: $100 a day for 40 days which would be <br />the minimum, $4,000 and, you know, if we are not going with <br />the minimum civil penalty, I don't know. I don't know how tha <br />stands as far as the law goes, you know. The law states <br />$100 to $1,000 for mining without a permit and I don't know <br />if the Board has the option -- <br />CHAIRMAN TURNER: Sure, they do. <br />MR. McARDLE: They do? <br />MR.
