III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />feet. The two lifts were separated by a terrace, which was about 20 feet in width and had <br />a cross-sectional backslope and a longitudinal backslope of about 5 percent, as the <br />designs required. Graded refuse pile outslopes were approximately at 2H:1 V, as required <br />by the designs. <br />With-ail parties in agreement, the verification of four feet of cover was delayed until <br />auger equipment could be brought in to verify the depth of cover on the pile. The OSM, <br />BLM aad Mr. Pavlisick allagreed-that they should be notified of the date-ofthis-second <br />inspection and the results of that inspection, but that only the operator and the DMG <br />would perform the inspection. BRL stated that, before the second inspection of the West <br />Ridge waste pile will take place, the boundary between BLM land and the land owned by <br />Mr. Pavlisick would be surveyed in and mazked to see if any portion of the West Ridge <br />waste pile is on land owned by Mr. Pavlisick. <br />East Mine -Crusher/screener Bench <br />At the crusher/screener bench, BRL requested bond release for structural demolition of <br />facilities superstructures, but not for concrete items. The inspection showed that all <br />superstructures and belt strucriues have been demolished and either xemoved from the <br />site for salvage or buried in two county-approved pits located at the back of the <br />crusher/screener bench. The demolished superstructures include the crusher/screener <br />plant, lump bin, master control center, truck loadout and stacking tube. The demolished <br />belt structures include the transfer tower no. 2 and the elevated and on-grade overland <br />conveyor. The concrete footers, walls, floors and slabs remain. These concrete structures <br />will be broken up and placed against the highwall before backfilling. The waste oil <br />storage bin and oil tank remain on the west end of the crusher/screener bench. The tank <br />will need to be cleaned before disposal at a certified waste site. The sewage plant was <br />also demolished and removed from the site. There is some mining machinery on this <br />bench that will need to be removed. <br />East Mine - Shon Bench <br />BRL requested bond release for structural demolition of the facilities structures at the <br />shop bencfi._ The concrete structures were not included in the bond release request. The <br />superstructures for the shop, warehouse, fire shop, loading bin and firehouse were <br />demolished and either removed from the site for salvage orburied in acounty-approved <br />pit at the back of the shop bench. The bottom concrete-encased portion of the 2000 ton <br />surge bin remains. Concrete walls, floors, pavement and footings remain, including the <br />loading dock wall, the solid waste storage bin and the sediment trap. <br />
