This revision will add the remainder of the existing
federal coal lease C-1362 (3430 acres) and private fee lease coal (1820 acres).
This letter presents the Divisions preliminary adequacy questions, organized by the pertinent sections
of the rules and regulations of the Colorado Mined Land Reclamation Board. The Division's deadline
for PR-10 is August 6, 2004. The Division may, for good cause shown, extend the time for the
proposed decision up to an additional 60 days (October 5, 2004). Since additional data are being
collected by MCC at this point, it is anticipated that an extension will be needed to allow MCC
sufficient time to complete the data collection and time for the Division to complete the review of PR-
10. Please provide a timeframe in which MCC anticipates responding to this letter.
Comments regarding the PR-10 application have been received from the US Forest Service, the
Colorado Division of Water Resources, the State Historical Preservation Office, and the Minnesota
Canal and Reservoir Company. Copies of the letters aze attached for your information. The Division
has included questions regarding the concerns raised in these comment letters in the pertinent sections
of this letter.
2.03.6 Right of Entry and Operation Information
The maps showing the lease boundazies (Maps 1, 2, 51, 52) show Minnesota Reservoir Tying
within the boundary of lease C-1362.
