Cattany <br />. <br />. <br />ox Division Director <br />Somerset CO 81434 Natural Resource Trustee <br />Re: Adequacy Review of Permit Revision No. 10 <br />Dear Mr. Barbe: <br />The Division of Minerals and Geology (The Division) has reviewed the permit revision application <br />materials submitted by Mountain Coal Company (MCC), C-1980-007, for the purpose of adding 5,250 <br />acres in the South-of-Divide permit azea addition. This revision will add the remainder of the existing <br />federal coal lease C-1362 (3430 acres) and private fee lease coal (1820 acres). <br />This letter presents the Divisions preliminary adequacy questions, organized by the pertinent sections <br />of the rules and regulations of the Colorado Mined Land Reclamation Board. The Division's deadline <br />for PR-10 is August 6, 2004. The Division may, for good cause shown, extend the time for the <br />proposed decision up to an additional 60 days (October 5, 2004). Since additional data are being <br />collected by MCC at this point, it is anticipated that an extension will be needed to allow MCC <br />sufficient time to complete the data collection and time for the Division to complete the review of PR- <br />10. Please provide a timeframe in which MCC anticipates responding to this letter. <br />Comments regarding the PR-10 application have been received from the US Forest Service, the <br />Colorado Division of Water Resources, the State Historical Preservation Office, and the Minnesota <br />Canal and Reservoir Company. Copies of the letters aze attached for your information. The Division <br />has included questions regarding the concerns raised in these comment letters in the pertinent sections <br />of this letter. <br />2.03.6 Right of Entry and Operation Information <br />The maps showing the lease boundazies (Maps 1, 2, 51, 52) show Minnesota Reservoir Tying <br />within the boundary of lease C-1362. The lease specifically excludes the Minnesota Reservoir. <br />Please amend the maps to show the boundaries of lease C-1362 accurately. <br />2. In the summary of additions/deletions in the revision application packet many maps were listed <br />which were not included in the packet.
