In Gunnison County, Joanne stated that there are no zoning designations. According to
the permit document, In Gunnison County there are two land uses which are designated
use by right; agriculture and residential. Joanne Williams checked the records file and
confirmed that the subject property is described as "agricultural use". She informed me
that a Land Use Change Permit would be required if uses other than agriculture would
be proposed for [he property. There has been no Land Use Change Permit filed for the
property with Gunnison County. I requested that she send me a description of
"agricultural use".
(3) As stated on page 2.04-4 of the permit document, pre-mining land uses on private lands
within the West Elk Mine permit azea included cattle grazing, wildlife habitat, and
dispersed recreational activities (hunting, trapping, off-road vehicle use).
The "post-mining" land uses are not real clearly stated in the permit document. On page
2.05-95 of the permit, MCC states "it is desired to provide final reclamation of the
disturbed areas that is self-sustaining and provides habitat suitable for domestic livestock
and wildlife". Essentially, the post-mining land use is rangeland and wildlife habitat.
(4) Attached, please find copies of Mr. Mautz' two appraisals.
Please let me know if I can provide further assistance.
c: David Berry
Susan McCannon
