Mr. Gregg Squire
Division of Minerals & Geology
Apri127, 1998
Page 2
3. Presently the creek tops County Road 3 during a significant rainfall event. At the
boundary of our Phase 1 and 2 mining azeas, there is a depression in the road where
runoff flows over the road and continues east. Here we will grade a 20:1 slope down into
the mining area. Because the road slopes up in either direction from this low point, we
believe that the southwest comer of the Phase 2 area will not be overtopped in a rainfall
event. Therefore, we do not believe any erosion will occur in this area.
4. The concrete rubble will be kept in a defined channel to keep the higher velocity stream
flow over the stabilized azea. Also we have placed this material down [he entire length of
the slope to the pit floor. Also, you will note that concrete rubble will be installed on the
western end of the Phase 3 mining.area where the slope is also 20:1.
Phillips County officials have cornmitted to contact the Corps of Engineers office prior to
placing any fill in Sandy Creek.
6. We will commit to replace Yellow Sweet Clover with Ladak Alfalfa. These seeding rates
are in pounds per live seed (PLS) per acre. PLS is the percent purity times percent
germination.
Last week we continued the decision date for this application to April 30, 1998. Also with this
letter we have provided copies of the required notices and newspaper publications. Please call
me if you have any questions.
Cordially,
TUTTLE APPLEGATE, INC.
~./ . / (J ~(1~-~
Gary J.
