<br />3.1.3 Application Reviews and Responses
<br />Comments on the Application were received by letter of May 8, 2001 from the Corps of
<br />Engineers and were transmitted to the Applicant by Division letter of May 10, 2001; and from
<br />the Colorado Historical Society by letter of May 24, 2001 and were transmitted to the Applicant
<br />by Division letter of June 4, 2001.
<br />The Application was reviewed for adequacy. The Division, by letter of July 16, 2001 provided
<br />comments on the Application to the Applicant. CEC responded satisfactorily to adequacy items
<br />by letter of August 3, 2001.
<br />3.1.4 Status of Pemut Stipulations
<br />There aze no stipulations on this permit at this time. Stipulations 1 through 4, 6 through 16, and
<br />18 of the original permit were resolved during the first five-yeaz permit term. Stipulations 19, 22
<br />and 27 were resolved during the second five-yeaz permit term. (Findings, 1992) Stipulations 5,
<br />17, 20, 21, 23, 24, 25, 26, 28, 29. 30, 31 were resolved during the third five-yeaz permit term.
<br />3.1.5 Technical Revision (TR)
<br />Two Technical Revisions (TR) were processed since the February 18, 1998 Proposed Decision
<br />and Findings of Compliance for the Keenesburg Strip Mine C-81-028 Permit Renewal No. 3. A
<br />summary of them follows.
<br />TR-32, approved September 28, 1998, permitted permanent retention of Sedimentation Pond No.
<br />2 and associated perimeter diversion ditches.
<br />TR-33, approved February 16, 2001, permitted a change in the permit boundary.
