Sec Section <br />2. Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve this Application for <br />renewal of a valid existing permit. This decision is based on a finding that the operations will <br />comply with all requirements of the Colorado State Program as found in the Colorado Surface <br />Coal Mining Reclamation Act, Colorado Revised Statutes 34-33-101 et seq., and the Regulations <br />promulgated pursuant to the Act. If no request for a formal heazing is made within thirty (30) <br />days of the first publication of the issuance of this proposed decision, then this decision becomes <br />final. Acceptable surety has been submitted by the applicant. The Application, all supporting <br />documentation and any stipulations or conditions will become a binding part of the Permit. <br />3. Summary <br />3.1 The Review Process <br />3.1.1 Initiation of Renewal <br />The Division of Minerals and Geology (Division) notified the Coors Energy Company (operator) <br />on January 30, 2001, that the existing Permit for the Keenesburg Mine would expire on <br />November 3, 2001. Coors Energy Company (Applicant) responded on April 24, 2001 with an <br />application (Application Submittal Date of OS/O1/01) for permit renewal. The Division deemed <br />the Application complete on May 1, 2001. <br />3.1.2 Public Notice <br />Public notice of submittal of the Application was published, by the Coors Energy Company <br />(CEC), in The New News on May 17, 24, 31 and June 7, 2001. Notice that the Application was <br />considered complete for the purposes of filing was provided by the Division, in accordance with <br />Title 34, Article 33, Section 118, Pazagraph 3, of the Colorado Revised Statutes, by letters of <br />May 1, 2001, to: <br />Donald W.
