I would note the provisions of Section 3 of the <br />Mining and Reclamation Permit which states that <br />"if analyses of the mining and reclamation <br />operation ... indicate that the operation will not <br />be able to comply with the requirements of the Act <br />... the operator hereby agrees to exercise its best <br />efforts, after consulting with the division, to <br />modify the plans to correct such deficiencies in <br />the future. Such modifications may require <br />technical revisions or amendments to the permit." <br />It would seem to me that perhaps a technical revision <br />maybe in order. <br />We would welcome the opportunity to meet with you to <br />discuss this matter at your convenience.
