Furthermore, the location <br />as mined is still well within the boundaries of property <br />belonging to Pete Lien & Sons, Inc. <br />i Since last visiting with you we have confirmed that in <br />facia we have inadvertently deviated from the original mining <br />r plan. The deviations extends the western most boundary of <br />the present pit approximately 300 feet to the west of what <br />was anticipated as shown on the map for Exhibit "E". I <br />believe you have now received a copy of the Larimer County <br />Plalining Commission Report and Addendum. Mr. White from <br />Lar:imer County describes this situation. <br />You should also be aware that though we have deviated <br />from the original mining plan boundary, and though we are <br />within the quarter quarter section authorized for mining by <br />the MLRD, that we have not exceeded ten acres in total <br />dis'curbance (including stock pile areas), and the mining has <br />occurred within the property included within the application <br />for expansion of the permit to a large scale regular (112) <br />operation. Thus, it would be our position that since we have <br />not deviated from the land permitted to be mined as shown on <br />Exhibit "A" of the 1989 application, no violation has <br />~~ <br />•uca. <br />
