Dept of Natural Resources <br />Re: Additional Modifications to Wyoming Fuel Company's Department of Atmy Permit <br />No. CO-OYT-0381. <br />Dear Ms. Culp: <br />As you are probably aware an January 29, 1985, I submitted a request for <br />modification to our Permit for diverting the Middle Fork of the Purgatoue River based on <br />our January 25, 1985 submittal to the Colorado Mined Land Reclamation. On Februrary 8, <br />1985 I received a letter from Mr. Peixotto granting this modification. <br />• Since these submittals, Wyoming Fuel and the Colorado Mined Land Reclamation <br />Division have renegotiated rip-rap placement and sediment control during the <br />construction process. My correspondence to the State dated February l2 and February 18, <br />is enclosed. Figure F-1 (revised 2/18/85) is the final plan. <br />Basically, the Division has agreed to lower Rip-rap standards as shown on Figure <br />F-1. However, the Division has stipulated, Wyoming Fuel must monitor slope stability to <br />evaluate the need for more rip-rap in the future. In addition, Wyoming Fuel will be <br />required to submit a bond in the amount to cover the cost of rip-rapping to original design <br />specifications. <br />If you have any questions regarding this please call myself or Luke Kolin at Wyoming <br />Fuel or Ms. Candace 'fiompson at the Division (303/866-3567). <br />Tha~ <br />David M.
