J. 1VING0, hereinafter referred <br />to as the Lessors, and THE Sl:Mi1,IIT PRESSED BRIC}i AND TILE COMPANY, <br />a corporation, hereinafter cal Led the Lessee, <br />WI'PNESSETH: <br />That in consideration of One Dollar and other good and valuable con- <br />siderations, together with the payment of the royalties hereafter mentioned by <br />the Lessee to the Lessors, the Lessors hereby lease to The Summit Pressed <br />Brick and Tile Company the following described property located in Fremont <br />County. Colorado, to-wit: <br />The West 1/2 of the South~tirest 1/4 of Section 4, <br />'T'ownship 18 South of Range 71 Nest of the Sixth <br />Principal Meridian. <br />The purpose of this lease is to give the Lessee the right to mine, develop, <br />remove and explore for nonmetallic clay in and from the property above mcn- <br />tinned, and to haul the same from said property. <br />i <br />TO HAVE AND TO hLOLD the same unto the Lessee for a term of five <br />years fr•um date hereof; providing that during said term the Lessee agrees to pay <br />the Lessors 30 cents per ton For every ton of clay hauled from the premises, and <br />the Lessee shall furnish an accounting of all clay mined on a monthly basis, and <br />shall m~.ke payment of all sums clue on or before the 7 5th day of the next suc- <br />ceeding month. <br />The Lessee agrees to pay a minimum royalty of p500 per year, it being <br />understood that the Lessee shall receive credit each year fur any sums paid on <br />the basis of 30 cents per ton, and in the event these royalties exceed $500, no <br />additional sums shall he due. if the sums so paid shall by less than x500, the <br />
