Construct a secondary lateral ditch to drain the seepage area described in item <br /> no. 7 above into the main pit interior drainage ditch. <br /> 3. Establish vegetation on the levee in accordance with the approved permit and <br /> with the performance standards of Rule 3,1,10 of the Construction Materials <br /> Rules and Regulations of the Mined Land Reclamation Board (Rules). <br /> Revegetation is not required for those portions of the levee plated with rock or <br /> riprap. <br /> 4. Upon completion of the foregoing three items, request reclamation <br /> responsibility release for the levee in accordance with Rule 4.13 or Rule 4.16." <br /> Since the April 13, 1998, inspection, Western Mobile has provided the Division <br /> with an as-built survey of the crest elevations of the completed perimeter levee; <br /> constructed a secondary lateral ditch to drain the seepage area as described in Item 2 <br /> above; and reseeded the levee in accordance with the approved Reclamation Permit. <br /> Following the most recent inspection, the Division concluded that "overall the <br /> levee is well maintained and in excellent condition." <br /> The most recent inspection(February 18, 1999) was occasioned by a written <br /> request from "Neighbors for a Livable Boulder" (NLB), who expressed concern about <br /> ground-water seepage through unmined portions of the Deepe Farm Pit perimeter and <br /> the subsequent development of wetlands in those areas. As I understand it, the NLB is <br /> concerned that this seepage will undermine their confidence in the stability of the <br /> Deepe Farm Pit levee/berm, and that the best course of action to evaluate the effect of <br /> the seepage on the stability of this structure is to conduct a piping analysis, which the <br /> Division has identified as the required "corrective action." <br /> While Western Mobile believes that they have met all of the Division's <br /> previous requirements regarding TR 006; nevertheless, the company has asked <br /> CTL/Thompson to carry out a piping analysis pursuant to the methods described in <br /> your February 22, 1999, Inspection Report. The results of this analysis should be <br /> available to the Division no later than the end of March 1999. <br /> In order to bring some degree of closure to responsibilities related to the <br /> Deepe Farm Pit perimeter levee, Western Mobile proposes to request partial <br /> reclamation release for the levee/berm from the Division. This release will cover all <br /> reclamation obligations related to the levee/berm on the part of Western Mobile except <br /> for <br /> Mr. Allen C.
