As the Division of Minerals and Geology <br /> (Division) is aware, Western Mobile has fully complied with all stipulations that the <br /> Division attached to their approval of Technical Revision JR 006). Since that time, the <br /> Division has inspected the Deepe Farm Pit berm on two separate occasions. <br /> On April 13, 1998, the Division inspected the Deepe Farm Pit berm. The <br /> subsequent Inspection Report noted: "It was observed that at several locations seepage is <br /> emerging from the toe of the pit side slope." The Inspection Report went on to say: <br /> "Based on the observations made during this inspection and upon review of the <br /> levee raise construction report, the Division has determined that the following <br /> issues remain to be addressed for the operator to be released from any further <br /> reclamation responsibility related to the Deepe Farm Pit perimeter levee: [emphasis <br /> added] <br /> 1.
