Shomaker, Inc. of Albuquerque, NM - nominated by the Parties <br />Ann S. Maest, PhD. of Boulder, CO - nominated by the Parties <br />To Serve as Independent Laboratory <br />Core Laboratories, Inc. of Aurora, CO - nominated by BMRI <br />Analytical Technologies, Inc. of Tempe, AZ - nominated by the Parties <br />In order to complete an enlightened selection, the Division will Weep to <br />solicit complete and up to date Statements of Qualifications from eaFFh of the <br />nominees. Several SOQ's supplied were lacking recent entries. No S~Q has <br />been supplied for Analytical Technologies, Inc. We will also reques <br />appropriate schedules of professional fees from each potential contractor. <br />In concurrence with comments forwarded by the Parties. I do not believe it <br />would be appropriate for any contractor supplying services to BMRI t also <br />participate in the independent Sampling and analysis efforts. If BM I intends <br />to continue using Core Laboratories for processing your required mon toring <br />samples, I will exclude them from consideration. Please indicate yo~r <br />preference. If you desire to nominate another EPA certified analyti al <br />laboratory, please submit your nomination by Friday, July 17th. <br />Once we have completed our deliberations, I will announce our selection to <br />BMRI and the Parties. It is my intention to present the Division's <br />recommendation to the Board at their August 26 - 27 meeting for their <br />concurrence. <br />Development of a Three Party Contract <br />In your May 4, 1942 letter which covered your TR-004 application, you <br />discussed the negotiation and finalizing of a contract between BMRI, the <br />Division, and the third party contractors. Candidly, the Division ha no <br />experience in drafting a third party contract. In the interest of ex editing <br />this process, the Division would welcome any assistance BMRI might beywilling <br />to provide. <br />Miscellaneous Related Comments <br />We have been considering the Board's independent sampling and analysis <br />directive at considerable length during the past several months. In }he <br />interest of stimulating consideration, I offer the following miscellaheous <br />comments for your response. <br />
