Long, <br />Division Director <br />Re: Independent Sampling & Analysis, by a Third Party, at BMRI's Expense <br />Dear Mr. Douchane; <br />Within its Order of May 28, 1992, the Board directed Battle Mountain <br />Resources, Inc. as follows. <br />21. BMRI's application for a technical revision submitte <br />in response to item t12) of the Abatement Requirements, entitle <br />"Modification of Monitor Sampling & Analysis Protocol", shall: <br />a. comply with all applicable statutes and regulations; <br />b. comply with the requirements specified in item (12) ofl <br />the Abatement Requirements; and <br />c. provide for independent sampling and analysis, by a <br />third party at BMRI's expense, at a frequency to be deter-~ <br />mined by the Mined Land Reclamation Division to verify <br />pertinent data." <br />Subsequently, the topic of the independent sampling and analysis has ~een <br />addressed in technical revisions, adequacy comments, responses to ade uacy <br />comments, as well as miscellaneous correspondence among the various p rties, <br />BMRI and the Division. <br />Selection of Independent Contractors <br />As I stated in the hearing, the Division intends to select contractor to <br />perform the independent sampling and analysis at our direction, from ominees <br />provided by BMRI and the Parties. BMRI has submitted one nomination each of <br />professionals to conduct sampling and analysis. Nora Jacquez, actinglIas <br />attorney for the parties, has submitted two nominations of profe55iond15 to <br />conduct sampling and one nomination of an analytical laboratory to co plete <br />analysis. <br />
