THIS DEED, made this day of May, 1994, between RIMI20CK COAL <br />CO., a corporation duly organized and existing under and by virtue <br />of the laws of the State of Colorado, whose legal address is 1390 <br />Ash Street, Denver, Colorado 80220, of the City and County of <br />Denver and State of Colorado, of the first part, and FISHERS PEAK <br />LAND COMPANY, a corporation duly organized and existing under and <br />by virtue of the laws of the State of Colorado, whose legal address <br />is P.O. Box 398, Trinidad, Colorado 81082, of the second part: <br />WITNESSETH, that the said party of the first part, for and in <br />consideration of the sum of Ten Dollars ($10.00) and other good and <br />valuable consideration, to the said party of the first part in hand <br />paid by the said party of the second part, the receipt whereof is <br />hereby confessed and acknowledged, has granted, bargained, sold and <br />conveyed and by these presents does grant, bargain, sell, convey <br />and confirm unto the said party of the second part, its successors <br />and assigns forever, the following described property situate, <br />lying and being in the County of Las Animas and State of Colorado, <br />to-wit: <br />ENGLEVILLE TRACT II <br />The east 33 acres of the SE1/4NE1/d Section <br />30, Township 33 South, Range 63 West of the <br />6th P.M., according to the Decree of Partition <br />recorded January 31, 1895, in Book 84, Page <br />237, more fully described as follows: <br />Beginning at a marked rock the 1/4 corner <br />between Sections 29 and 30, Township 33 South, <br />Range 63 West, thence west along the South <br />boundary line of the North East Quarter <br />(NE1/4) of Section Thirty (30) the distance of <br />Ten Hundred and Seventy-five (1075) feet to a <br />point; thence north and parallel with the East <br />boundary line of said NE1/4 Thirteen Hundred <br />and Thirty-Seven and Five Tenths (1337.5) feet <br />to the North boundary line of the SE1/4 of the <br />NE1/4 Section 30; thence east along the said <br />North boundary of SE1/4 of NE1/4 Ten Hundred <br />and Seventy-Five (1075) feet to the East <br />boundary line of said NE1/4 Section 30; thence <br />South on East boundary line of said NE1/4 <br />Section 30, Thirteen Hundred and Thirty-Seven <br />and Five Tenths (1337.51 feet to the place of <br />beginning, being Thirty-Three (33) acres off <br />the east end of said S1/2 of NE1/4 of Section <br />30 and designated on the plat hereinafter set <br />out as Lot No. 1. <br />
