There were three separate <br />violations contained within the TDN. <br />Violation #1 was for failure to design and certify the impoundment <br />which was constructed at the outlet of Haulroad Ditch A5. This <br />structure was built at the Division's request to help with <br />controlling runoff and sediment from road construction and the road <br />surface itself. It was by no means meant to be a sedimentation pond <br />which would have required a design and certification. Seneca has <br />breached the dam at this impoundment since the March inspection. <br />Two rows of straw bale barriers in combination with silt fence have <br />been installed in the drainage below the outlet of HRD-A5. Seneca <br />believes that these alternate sediment control measures will <br />provide the same control that the sump did. <br />Violation #2 addresses the area below the outlet of culvert A-3. A <br />series of sumps and silt fences were installed to prevent <br />additional sediment to the stream flow or to be deposited outside <br />the permit boundary. OSM stated that at least one of these <br />structures was constructed outside the boundaries of the permit. A <br />review of Exhibits 13-2, Surface Hydrology Map, and 13-13.2 Road A <br />(AS-BUilt), showed the permit boundary to be approximately 200 feet <br />from the centerline of the haul road. The permit boundary was <br />surveyed from a 1" = 400' scale map. At the time of the survey a <br />coordinate bust had occurred and some new surveys were made. The <br />fence line that exists in the field now is what the surveyors <br />staked as the permit boundary, and where the signs are placed. The <br />date on Exhibit 13-13.2 is 10-10-90 which was after the <br />construction of the fence line. The fence line and last row of <br />straw bale barriers and silt fence was surveyed and plotted to <br />check the location of the fence line/permit boundary. The fence <br />posts surveyed were right on with what is depicted on Exhibit 13- <br />13.2. We then taped from the centerline of the haul road out to a <br />distance of 200 feet. The fence line/permit boundary was <br />approximately 27 feet further to the south.
