~' <br />EXHIBIT C <br /> <br />The date of commencement shall be from August 15~, 1999 until approximately <br />August 1~', 2018. <br />2. The topsoil will be put to immediate use in conjunction with the gravel. No topsoil <br />will be stockpiled since there are areas of 1 inch or less of topsoil. However, in <br />places that may have salvageable topsoil, it will be salvaged. Reclamation will be <br />implemented at the conclusion of the mining activities, following the recommendation <br />of the Flagler Soil Conservation District. <br />3. As far as can be determined at this time, there is no overburden at the site. The soil <br />is all gravelly. <br />4. The depth of the mining operation will be between 10 and 20 feet. <br />5. The proposed road to be used for the mining operation is southwest of the pit area, <br />heading southwest or rn~rtheast. <br />6. There are no other significant disturbances to the land surface other than the <br />previous and proposed mining operations to be conducted. The area to be disturbed <br />will be no more than 1/2 an acre at a time. <br />7. The haul road is an existing road well developed prior to any mining operations. <br />(Please see exhibit A). This road will not be reclaimed as it is currently and will be <br />continually used as public access. This is not a new road and no new construction <br />or improvements to the road are specified at this time. There are no known <br />associated drainage an~i runoff conveyance structures that would be necessary for <br />this mining operation. <br />8. Water is not used in conjunction with this operation. <br />9. Groundwater will not be encountered, nor will surtace water be intercepted or <br />disturbed. <br />10. The nature of this operation will preclude the necessity of encountering conflict with <br />Colorado water laws and regulations. <br />11. There is no reason to bEalieve that refuse and acid or toxic producing materials will <br />be exposed in this operation; however, if this does occur, the landfill supervisor will <br />be contacted and the proper procedures will be implemented through the guidance <br />and recommendation of the Colorado Department of Public Health and Environment <br />- Hazmat Division. <br />12. Since the gravel mined ~~rvill be utilized "as is" for county road maintenance, there will <br />be no additional proces:aing. This operation will be strictly for digging for sand and <br />gravel with no other secondary, or incidental use. <br />
