The temporary roads <br />accessing the GVB will need to be obliterated and reclaimed as soon as the hole it <br />services is no longer needed, and reclamation has been completed. These temporary <br />roads will be closed to the public. Ingress to these locations will be from BRL property. <br />The existing gate at the Forest Boundazy will remain locked at all times, BRL will have <br />access for administrative use only (i.e. drilling and monitoring purposes), no other uses <br />will be allowed. Also refer to the Conditions of Approval in Appendix B. <br />5. ~Aceess to the three monitor wells (BRL-00-65-MW, BRL-00-66-MW and BRL-00- <br />67-MW):for•about 20 years. Access using=full-sizedwehicles; ATVs or snowmobiles: <br />The minimum vehicle size for weather and road conditions will be used. Ingress to holes <br />BRL-00-65-MW and BRL-00-66-MW will be from BRL property. Changing stipulation (i)(5) on the Iron Point Federal Coal Lease (COC-61209) to read, <br />"With regard to protecting elk on the winter range,-during calving season, and <br />minimizing surface damage, no surface use (exploration, drilling and development <br />activity) will be allowed from December 1 through June 15." <br />7. Changing stipulation (i)(6) on the Iron Point Federal Coal Lease (COC-61209) to read, <br />"If new road access is required for the construction of degasification boreholes or <br />ventilation shafts, accesses will be obliterated. Until obliteration, all new accesses will be <br />closed to the public." <br />We have determined that there is not a need to decide on adding access to monitoring <br />wells under Stipulation (i}(6), as none of the wells were drilled using temporary roads, <br />existing routes will be used for access. <br />I am also granting a project level exceptiomto the riparian.occupancy~stipulation for the= <br />Hubbard Canyon trail improvement authorized in his decision (see item l a above). <br />Stipulations can be revisited on a case-by-case basis with proper NEPA documentation, <br />which has been provided in the EA (see Section III of this document). This exception is <br />being made for the riparian occupancy stipulations for both the CEL (a)(3) and FCL <br />(i)(4). <br />CEL stipulation (a)(7) states that "fueling and lubricating vehicles will be prohibited <br />within 100 feet of streams and wetlands. ~No fuebstorage~willbeFallowed within-500 feet: <br />of any water bodies." Since~IP99-3 drill-site is within;l00 feet'of Hubbard Creek; <br />addirional'mitigation measures will betaken to~erisure thafall'fuel~or-Iubricating•liquids~ <br />are contained. All fuel and lubricating liquids for the drilling operation will be stored off <br />4 <br />
