Mr. Michael Long <br />May 16, 1995 <br />Page 5 <br />Summary and extenuating circumstances as of May 16,1996: <br />Yoast Mine construction will continue in 1996: <br />155 acres topsoil removal <br />3.5 miles of haul road to construct <br />Sediment pond construction <br />Facilities construction <br />Current mining/reclamation at II-W requirements during 1996 <br />79 acres to be graded <br />60 acres of topsoil to be removed <br />Current mining/reclamation at Seneca II requirements during 1996: <br />14 acres to be graded <br />72 acres of topsoil to be replaced <br />As you can see, we have an abundance of earthwork for the 1996 construction and <br />reclamation season. This earthwork will take all the manpower and equipment we can <br />muster. Since the dirt season is so short in Northwest Colorado we may not have time to <br />get everything completed. If we can wait to begin correcting this NOV until next summer <br />you can be asswed of a better quality finished product. Also, ow coal supply agreement <br />with Public Service, Hayden Station, allows us to pass on costs for reclamation work. <br />However, Public Service is currently under presswe to retrofit the Hayden Station to meet <br />EPA requirements. This yeaz is not a good time to hit Public Service with any bills out of <br />the ordinary. Please consider allowing us until next summer to correct this NOV. Also, <br />please re-examine the facts to see if there is any other viable alteroatives. Seneca believes <br />redistwbing this 21 acre azea will be detrimental to the vegetation ah-eady established, the <br />potential for loss of topsoil quality and quantity by handling two more times, and the fact <br />that past inspectors have mentioned how nice the existing reclamation area blends in with <br />the undisturbed ground even though it does not approximate the approved postmining <br />topography plan. <br />Sincerely, <br />~ ~~~ <br />G.
