In response to the NOV, received on October 23, 1995, Seneca Coal Company <br />submitted letters to Ms. Susan Burgmaier (11-1-95) and Ms. Erica Crosby (1-11-96), <br />containing information addressing this violation. Today, we are submitting to you <br />condensed versions of those letters and an explanation of why we need your help. This <br />letter contains: <br />• A brief history of the area in question <br />• Quotes from DMG inspection reports <br />• Preliminary abatement options <br />• Redesigned channel specifics <br />• Current abatement options <br />• Summary and extenuating circumstances <br />A brief history <br />The grading in the B pit highwall area and associated drainage channel reconstruction <br />began in September, 1994. The final pit highwall was blasted to help in highwall <br />reduction. Dozers graded the area in late September, 1994. The topsoil was re-spread <br />from stockpile N and reseeded during October 1994. After the snowmelt and heavy rains <br />during the spring of 1995, a lazge gully formed in the extended portion of 006-NE-1 <br />drainage channel. Seneca personnel conducted the 1995 Rill & Gully monitoring, in May, <br />as required and submitted the maintenance plan to the DMG. During the summer of 1995, <br />riprap was placed in the eroded sections of the channel, approximately 300 ft x 30 ft and <br />150 ft x 30 ft. Inspectors from DMG have mentioned this specific area nine times since <br />September, 1994. <br />Seneca Coal Company ' P.O.
