• ~ 4 <br />B) Complete the installation of all components of the Revised Drainage Control Plan no later than March 31, <br />2002. <br />C) Submit no later than May 3l, 2002 a complete set of As-Built Drainage Control Designs for each component <br />of the Revised Drainage Control Plan certified by a qualified registered professional engineer and a statement <br />certified by a qualified registered professional engineer that each component of the Revised Drainage Control <br />Plan has been properly installed. <br />CIVIL PENALTY <br />A person who violates any provision of a permit issued under C.R.S. 34-32.5-101 et. s~ shall be subject to a <br />civil penalty of no[ less than $100 per day, nor more than $1,000 per day for each day during which such <br />violation occurs (C.R.S. 34-32.5-124(7)). >n this matter, the Board might assess a civil penalty of $ 4,800 [o <br />$ 48,000 for 48 days of violation at $ l00 to $ 1,000 per day. (July 5, 2001 -August 22, 2001 = 48 days) <br />SUSPENSION OF CIVIL PENALTIES <br />The Board may suspend all or a portion of the civil penalty to encourage timely compliance with the corrective <br />actions, as well as compliance with the Act and Rules and Regulations. <br />The Board may also suspend all or a portion of the civil penalty based on the permittee's efforts to correct the <br />violation(s) prior to the Board hearing.
