We can't hear the merits of this thing, and <br />7 we have lost all of expense going to file this permit. We have <br />8 lost your resource time and your personal time, and then we are <br />9 back to square one. <br />10 CHAIRMAN DANIELSON: To when you are asking for <br />11 continuance? <br />12 MR. BRIGGS: Until we are out of violation, and when <br />13 you decide that, we are ready to go. I mean the rules don't give <br />14 you any guidance on that. The statute doesn't give you any <br />15 guidance on that. Our fear is that they'll say, well, if you <br />16 are found in violation it's the original sin. You will never be <br />17 out of it or when the trees grow. You know, that's our concern. <br />18 CHAIRMAN DANIELSON: Okay. Mr. Nussbaum, again, we are <br />19 just addressing the request for continuance. That is all I am <br />20 going to request. <br />21 MR. BANTA: You are requesting a continuance. <br />22 MR. NUSSBAUM: No, we are not at all. I have great <br />23 fear that this Board grants a continuance, that it will lose it's <br />24 ability to make a decision regarding this issue.
